1. Agreement to Terms & Conditions of Sale 
By accessing the XFactor Motorsports Derby Page, and buy purchasing our physical racing parts, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these terms, you may not access or use our services.

2. Purchases, Pricing, and Payments 
All prices are subject to change without notice. We reserve the right to refuse or cancel any order at our sole discretion, including orders with pricing errors or suspected fraud. Payment processing is handled securely via Stripe.
3. Shipping, Delivery, and Risk of Loss 
We arrange for the shipping of physical parts to your specified address via third-party carriers. the risk of loss and title for items purchased from Xfactor Motorsports pass to you upon our delivery of the times to the shipping carrier.

4. Returns and Refunds
Returns are subject to our specific return policy. Generally, parts must be uninstalled, unaltered, and in their original packaging to be eligible for a return. Please contact support to initiate a return of merchandise authorization (RMA).

5. Assumption of Risk & Limitation of Liability 
WARNING: Auto racing is an inherently dangerous activity. All racing parts are sold “AS-IS” without any warranty, express or implied, including fitness for a particular purpose. Xfactor Motorsports shall not be liable for any special, incidental, or consequential damages, injury, or death arising from the installation or use of these parts. Installation should be performed by qualified professionals.

6. Dispute Resolution & Arbitration 
Any dispute arising out of or relating to these Terms or your purchase shall be resolved by binding, individual arbitration, rather than in court. You agree to waive any right to participate in a class action lawsuit. These Terms shall be governed by the laws of the State of Missouri, without regard to its conflict of law principles.
